In the State of North Carolina, Homeowner's Associations are governed by the Planned Community Act, Chapter 47F to be exact. This Act outlines the law in creation, management, and powers of the POA/HOA. It includes provisions for the declaration of covenants, bylaws, and enforcement of community rules. POA/HOAs must follow this ACT when managing community common areas, collecting assessments and handling disputes resolutions.
In the State of North Carolina, Homeowner's Associations fall under the domain of North Carolina Non-profit Corporation Act or Chapter 55A. Pine Mountain POA, Inc falls under it too. The North Carolina General Assembly's website has the entire document available for reading and/or download. The Act gives the outline for board meetings, member's voting rights and record keeping. Since the POA is a non-profit organization, it must adhere to state specific requirements which include but are not limited to, fiduciary duties and responsibilities and financial management practices.
In the State of North Carolina, Homeowner's Associations must follow and abide by the US Fair Housing Act. This Law protects against discrimination in residential communities.
The Freedom of Information Act (FOIA) does not apply to PMPOA since our Association is not a government entity.
The Public Records Act does not apply to PMPOA since the Association is not a public entity.
